These Terms of Use (“Terms”) govern your access to and use of the websites, applications, dashboards, content, and services provided by ApexTrend AI, Inc. (“ApexTrend,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms.

Research & Education Only — Not Investment Advice. ApexTrend provides analytics, model outputs, and research signals (including probabilities, scores, rankings, and illustrative examples) for informational and educational purposes only. We are not a broker-dealer or investment adviser, and no content constitutes a recommendation to buy, sell, or hold any security or to adopt any strategy. Markets involve risk and may result in loss of principal. Past performance does not guarantee future results.

1) Eligibility & Accounts

You must be at least 18 and legally able to form a binding contract.
You’re responsible for the security of your account, credentials, and any activity under it.
Provide accurate information and notify us promptly of any unauthorized use.

2) Research Content, Model Outputs & Performance Data

Outputs (e.g., probabilities, RF/LightGBM scores, “POP,” sample structures) are algorithmic estimates based on historical data and assumptions that may be wrong, incomplete, stale, or inapplicable to your situation.
Backtests & Hypotheticals. Any performance, win-rate, or distribution shown may include hypothetical or backtested results. Hypothetical performance has many inherent limitations and does not reflect actual trading, liquidity, or execution costs.
Examples (e.g., spreads or ranges) are illustrative only and omit factors such as real-time bid/ask, slippage, assignment risk, tax treatment, and margin impacts.
You are solely responsible for verifying pricing, risk, suitability, and compliance before acting.

3) Regulatory Status & No Fiduciary Relationship

Publisher’s Exclusion. ApexTrend is not registered with the SEC, FINRA, or any other regulatory authority as an investment adviser or broker. Our Services are offered as impersonal, general-interest financial research consistent with the “publisher’s exclusion.”
Your use of the Services does not create any fiduciary, advisory, or client relationship with ApexTrend.

4) Market Data, Third-Party Services, & Availability

Quotes, bars, news, or reference data may be provided by third parties and can be delayed, inaccurate, interrupted, or unavailable.
APIs and integrations (e.g., brokers, data vendors) are subject to their own terms; we don’t control their uptime or behavior.
Service availability may be interrupted for maintenance, changes, or events beyond our control.

5) Acceptable Use

No scraping, bulk exporting, automated extraction, or circumventing rate limits.
No reverse engineering, decompiling, or probing for vulnerabilities.
No unlawful, infringing, or harmful conduct, including sharing paid content outside your account.

6) Subscriptions, Billing, & Trials

Fees, billing cycles, auto-renewal status, and cancellation terms are shown at checkout or in your account. Unless stated otherwise, subscriptions renew automatically until you cancel.
Taxes and pass-through fees (if any) may apply. Any refund policy, if offered, is specified at purchase or in your account.

7) Intellectual Property

ApexTrend owns all rights in the site, models, content, and trademarks, excluding third-party materials.
You receive a limited, revocable, non-transferable license to access the Service for your personal or internal business use.

8) Feedback & User Content

If you submit feedback, suggestions, or improvements, you grant ApexTrend a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and create derivative works from that feedback for any purpose.
You represent you have the right to provide any content you upload or transmit and that it doesn’t violate third-party rights.

9) Disclaimers; No Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. YOUR USE IS AT YOUR SOLE RISK.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APXTREND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; ANY LOSS OF PROFITS, TRADING LOSSES, LOST DATA, OR BUSINESS INTERRUPTION; OR AGGREGATE LIABILITY EXCEEDING THE GREATER OF (A) AMOUNTS PAID BY YOU TO APEXtrend IN THE 3 MONTHS PRECEDING THE CLAIM OR (B) $100.

11) Indemnification

You agree to indemnify and hold ApexTrend harmless from claims arising out of your use of the Services or violation of these Terms.

12) Electronic Communications

By creating an account or using the Services, you consent to receive notices and communications electronically. We may communicate via email, in-app messages, or postings on the site.

13) International Access & Compliance

Access to the Services may be restricted where prohibited by law. Non-U.S. users are responsible for compliance with local regulations, including data, financial, and export control laws.

14) Force Majeure

ApexTrend shall not be liable for delay or failure to perform due to causes beyond its reasonable control, including acts of God, labor disputes, internet or hosting outages, cyberattacks, government actions, or failures by third-party providers.

15) Third-Party Links; No Endorsement

Links to third-party sites or resources are provided for convenience and do not imply endorsement. We are not responsible for the content, products, or services on or available from those sites or resources.

16) Severability; Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of such right or provision.

17) Changes & Termination

We may update these Terms by posting a revised version with a new effective date.
We may suspend or terminate access for any violation or misuse.

18) Governing Law; Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Exclusive venue lies in state or federal courts located in Delaware, and you consent to personal jurisdiction there.
